About Hibant Care

Hibant Care is an introductory care agency based in London. We operate a platform that enables families and service users to find and engage self-employed carers. These terms govern your use of our website and platform at hibantcare.com.

By accessing our website or creating an account, you agree to be bound by these terms. If you do not agree, please do not use our platform.

Our role as an introductory agency

This is important: Hibant is an introductory agency, not a care employer. We introduce families to self-employed carers and provide tools to manage those arrangements. We do not employ carers and are not responsible for the day-to-day delivery of care.

When a family engages a carer through Hibant, the working arrangement is directly between the family (or their representative) and the carer. The carer is self-employed and is responsible for their own tax, National Insurance, and professional conduct.

Hibant takes reasonable steps to verify carers before they appear on the platform, including DBS checks and reference verification, but we do not guarantee the suitability of any individual carer for your specific needs.

Creating an account

To use most features of the Hibant platform, you will need to create an account. You agree to:

• Provide accurate and truthful information when registering
• Keep your login credentials confidential
• Notify us promptly if you suspect unauthorised access to your account
• Be at least 18 years of age

You are responsible for all activity that takes place under your account. We reserve the right to suspend or close accounts that we reasonably believe are being misused.

Bookings and payments

Bookings made through the Hibant platform are agreements between the family and the carer. Hibant facilitates the booking and payment process but is not a party to the care arrangement itself.

Payments are processed securely via Stripe. By making a booking, you authorise Hibant to collect payment on behalf of the carer. Funds are held in escrow and released to the carer following confirmation of a completed booking.

Cancellation terms are agreed at the time of booking. Hibant's platform fee is non-refundable once a booking has been confirmed and the carer has been engaged.

Carer responsibilities

Carers on the Hibant platform agree to:

• Maintain a valid, enhanced DBS certificate
• Hold appropriate public liability insurance
• Comply with all relevant professional standards and legislation
• Be honest and accurate in their profile information
• Treat service users with dignity, compassion, and respect at all times

Hibant may remove a carer from the platform at any time if we receive credible concerns about their conduct or professionalism.

Acceptable use

You must not use the Hibant platform to:

• Provide false or misleading information
• Harass, abuse, or threaten other users
• Circumvent our platform to arrange care directly in a way that avoids our booking process
• Attempt to access systems or data you are not authorised to access
• Use our platform for any unlawful purpose

Limitation of liability

Hibant's liability to you is limited to the fullest extent permitted by law. In particular:

• We are not liable for the actions or omissions of any carer introduced through our platform
• We are not liable for any indirect, consequential, or special loss arising from use of our platform
• Our total liability to you shall not exceed the fees paid by you to us in the 12 months prior to the relevant claim

Nothing in these terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be limited by law.

Governing law

These terms are governed by the laws of England and Wales. Any disputes arising from these terms or your use of the Hibant platform shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Changes to these terms

We may update these terms from time to time. When we do, we will update the date at the top of this page and, where the changes are material, notify registered users by email. Continued use of the platform after changes take effect constitutes your acceptance of the updated terms.
